1. Who we are

Pool Covers is a trading name of [LEGAL COMPANY NAME].

New Zealand Business Number (NZBN): [NZBN] GST number: [GST NUMBER] Registered address: [REGISTERED ADDRESS]

2. These terms and your consumer rights

Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you acquire goods or services as a consumer.

Where you acquire goods or services for business purposes, you agree that the Consumer Guarantees Act does not apply, to the extent permitted by law.

If any part of these terms conflicts with your non-excludable statutory rights, your statutory rights prevail.

3. Products are custom-made

Covers are manufactured to the measurements and specifications you enter in our online ordering tool. Nothing ships from stock. This has consequences you should understand before you pay.

Your cover is cut to your pool. It cannot be resold to another customer, which is why change-of-mind returns are not available on custom items. See section 9.

You are responsible for the measurements you supply. We manufacture to the numbers on your order. Guidance is provided in our measuring guide, and our full position on fit is set out on our Warranty page.

We build in an allowance. Covers are manufactured 150mm larger than the pool dimensions you enter, across each dimension. This lets the edge sit up slightly against the pool wall rather than finishing dead on the waterline, and it absorbs small differences in measurement. The cover trims easily with sharp scissors if you prefer a flush finish.

Debris covers are measured differently. They are manufactured with a 200mm overlap beyond the pool edge, because they anchor to the surrounding deck rather than floating on the water.

Minimum billable area. Covers are priced per square metre with a minimum billable area of 2 m², regardless of the calculated area of the pool.

4. Pricing

Prices are shown in New Zealand dollars and include GST. Your tax invoice shows the GST component separately.

The price shown when you configure your cover is the price payable for that exact configuration. It is calculated from your measurements, your chosen cover and finish, any options and accessories, freight, and installation where you select it.

Freight and installation are shown as separate line items before you pay. There is no charge added after checkout.

If you email a saved price to yourself, that price is held for three weeks from the date it was generated. After that it is recalculated against current rates.

We price carefully, but if a genuine and obvious pricing error occurs we may cancel the affected order and refund you in full before manufacture begins. We will always contact you first.

5. Placing an order

Your order is an offer to buy. A contract is formed when we confirm your order by email.

We may decline or cancel an order before manufacture begins — for example if we cannot verify your measurements, cannot service your location, or a pricing error has occurred. If we do, we refund any payment in full.

Once manufacture of a custom item has begun, the order cannot be cancelled except as required by the Consumer Guarantees Act.

6. Payment

Full payment is required at checkout unless we have agreed otherwise in writing. We do not offer deposits, instalments or buy-now-pay-later.

We accept credit and debit card payment. Payments are processed by our payment provider, Wix Payments. We do not see or store your full card details.

7. Manufacturing and lead times

Custom covers are manufactured in 14 working days from the date payment is received. Delivery time is additional to this.

Parts, accessories and reels held in stock are dispatched separately and normally arrive sooner than a cover ordered at the same time.

Lead times are estimates rather than guarantees, and can move with demand, materials and season — pool covers are a seasonal product and spring is the busiest period of the year. If a significant delay occurs we will tell you rather than let the date pass quietly.

8. Delivery and installation

Full delivery and installation terms are on our Shipping & Returns page.

We deliver anywhere in New Zealand.

Installation is available in Auckland at a fixed price of $200, which covers on-site measurement and fitting. Outside Auckland we supply only. If you would like installation elsewhere in the country, contact us and we will tell you honestly whether we can arrange it.

Where we install, you are responsible for providing safe and clear access to the pool area.

9. Cancellations and returns

Custom-made products. Covers are made to your specification. We are not required to accept a return or provide a refund if you change your mind, and we do not offer one. This is consistent with the Consumer Guarantees Act, which does not create change-of-mind rights.

Covers made to measurements that turned out to be wrong. If you supplied the measurements and the cover was manufactured correctly to them, that is not a manufacturing fault and it is not covered by a refund or a free remake. If we measured the pool as part of our $200 measure and install service, the fit is our responsibility and we will put it right at our cost.

Faulty or non-conforming products. If a product is not of acceptable quality, does not match its description, or is not fit for a purpose you told us about, you are entitled to a remedy under the Consumer Guarantees Act — repair, replacement or refund, depending on the nature of the failure. See our Warranty and Shipping & Returns pages.

Stock items. Reels, parts and accessories that are not custom-made may be returned within 14 days of delivery if unused and in original packaging. Return freight is at your cost. This is in addition to your rights under the Consumer Guarantees Act, which apply in full if the item is faulty or not as described. See Shipping & Returns.

10. Warranty

Product warranties are set out in full on our Warranty page, including the pro rata schedules that apply.

Warranties are in addition to your rights under the Consumer Guarantees Act. They do not replace or limit them.

11. Our liability

To the extent permitted by law, and except for your non-excludable rights under the Consumer Guarantees Act and the Fair Trading Act:

  • We are not liable for indirect or consequential loss.

  • Our total liability for any claim is limited to the price you paid for the product giving rise to the claim.

  • We are not liable for loss or damage caused by incorrect measurements supplied by you, by misuse, by failure to follow the care instructions supplied with the product, or by normal wear and tear.

12. Intellectual property

All content on the Website — text, images, product photography, designs and the online ordering tool — is owned by or licensed to us and may not be copied, scraped or reused without our written permission.

13. Privacy

We handle your personal information in accordance with our Privacy & Cookies Policy and the Privacy Act 2020.

14. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published on the day you place it.

15. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

Terms & Conditions

These terms apply to every order placed with Pool Covers ("we", "us", "our") through [WEBSITE URL] (the "Website"). By placing an order you agree to them.

Please read section 3 in particular. Almost everything we sell is cut to the measurements you give us, and that changes what can and can't be undone after you order.
